These Terms of Service ("Terms") apply to your use of biothm.com (the "Site") and to all purchases made on it. "We" and "us" refer to the operator of the Site named in section 12. By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or use the Site under the supervision of a parent or legal guardian who accepts these Terms.

2. Wellness use

Biothm products are designed for general wellness, lifestyle, fitness and sports use. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Read the user manual and safety information before use. If you have a medical condition or an implanted electronic device, or are pregnant, consult a qualified professional before use.

3. Orders and payment

Please make sure the information you give at checkout is accurate. When you place an order, you agree to pay the total shown at checkout, including the product price, shipping and any applicable taxes. Payments are made by card through our third-party payment processor.

We may decline or cancel an order, for example if a product is unavailable, if there is an obvious error in a price or product description, or if we suspect fraud. If we cancel an order you have paid for, we will refund you in full.

4. Prices and product information

Prices are shown in your selected currency at checkout and may change without notice. Changes do not affect orders already placed. We aim to describe products accurately, but colors and images may vary slightly from the actual product.

5. Shipping, returns and warranty

Shipping, returns and refunds are covered by our Shipping Policy and Refund Policy. Our products have a limited warranty against defects in materials and workmanship:

  • 1 year from the date of purchase for devices, including hydrogen machines

  • 6 months for accessories, such as electrodes, sponge pads, ear clips, caps and leads

Under the warranty, we will repair or replace the defective product or part. Contact hello@biothm.com to make a claim; our customer service team will arrange the details, including shipping. The warranty does not cover normal wear and tear, misuse, modification or improper maintenance. It does not affect your statutory rights.

6. Intellectual property

All content on the Site, including text, images, logos and product names, belongs to us or our licensors. You may use it only for personal, non-commercial purposes and for shopping on the Site.

7. Reviews and submissions

When you submit reviews, comments or other content, you give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content, together with the name you submitted, in connection with the Site and our products. Your submissions must not be false, unlawful, abusive or infringe anyone's rights. We may remove any submission.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms limits any liability that cannot be limited by law or affects your statutory rights as a consumer.

9. Events outside our control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, such as natural disasters, epidemics, war, strikes, carrier disruptions or customs delays. If such an event significantly delays your order, you may cancel it and receive a refund for any items not delivered.

10. Changes

We may update these Terms from time to time. The version published on the Site when you place an order applies to that order.

11. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. If you are a consumer, you also keep the protection of any mandatory laws of your country of residence, and you may bring a claim in your local courts where the law allows.

Biothm is the brand of the products sold on biothm.com. The website is operated by DIGIPACE International Limited, 11A/F, Block 1, Camel Paint Building, 62 Hoi Yuen Road, Kwun Tong, Hong Kong, which is the seller and your contracting party for all purchases.
